High Court in Kampala has dismissed a petition by a ‘concerned citizen’ seeking to exhume the body of the late businessman Ivan Ssemwanga and recover money buried with him.
Abbey Mgugu dragged Bank of Uganda and A Plus Funeral Services accusing them of not restraining the Rich Gang members from throwing money in Semwanga’s grave at Nakaliro village in Kayunga district on May 30, 2017. He demanded court to grant him an order to exhume the late’s body in order to recover money buried with him.
But Presiding judge Magret Oguli-Oumo on Monday dismissed Mgugu’ s case against A-plus Funeral Management and Bank of Uganda as well as his request to exhume the body.
Justice Oguli ruled that the mode of contract that Ssemwaga’s family entered with A Plus did not include the supervision and enforcement of respect of currency notes.
Oguli further ruled that Mgugu accused the wrong party because it was not A Plus that threw the money in the grave.
After a careful perusal of Bank of Uganda Act, the judge also ruled, the central bank has no duty of enforcing respect of the Ugandan currency. BoU of Uganda also has no mandate of protecting other currencies that were buried with Semwanga such as the US dollar and the South African Rand.
