Deputy Attorney General Mwesigwa Rukutana has clarified on the allegation that he had a mutual relationship and sired a child with Justice Elizabeth Musoke.
In his statement dated 29 March, 2018, Rukutana regarded the allegation as false, malicious, unfounded and defamatory sayin he has never had any kind of relationship with Justice Musoke.
“I write to categorically deny the allegation and state that it is false, malicious, unfounded and defamatory, as I have never sired a child with the learned Judge or been in any relations with her at all,” he said in the letter addressed to deputy chief justice.
“For the above reasons, and to save squandering time on useless proceedings challenging the wild allegations. It is my humble prayer that considering the conduct exhibited in Court when we appeared on both occasions for conferencing, and this wild and unfounded allegation, this Honourable court establishes whether MALE KIWANUKA MABIRIZI is a fit, sound and proper person to engage in litigation by himself, well before embarking on the hearing of the Petition,”added Rukutana.
The Deputy Attorney General’s defence comes at a backdrop after Male Mabilizi Kiwanuka, one of the petitioners challenging the age limit constitutional amendment, asking Musoke to step down from the panel of the judges on grounds that she has had a relationship with Rukutana, who will be leading the defense team in the case.
In a letter written to justice Musoke and received by her chambers at the Constitutional Court, Mabirizi claimed that the judge has a child with Rukutana.
He also added that Justice Musoke also has 2 other children with the Minister in- charge of General duties in the OPM Hillary Onek who also supported the age-limit bill in parliament by voting YES.
Owing to the above, Mabirizi contended that justice Musoke is likely to be taking instructions from the two fathers of her children who are in very influential positions as regards to the age -limit petition and therefore she cannot make an independent ruling.
