Justice Kenneth Kakuru’s ruling on Age Limit petition

Today five justices of the Constitutional court led by Deputy Chief Justice Alphonse Chigamoy Owiny-Dollo, Remmy Kasule, Kenneth Kakuru, Cheborion Barishaki and Elizabeth Musoke are delivering their ruling on the controversial age limit petition.

The ruling is taking place at the Constitutional Court in Mbale.

Here is how Justice Kakuru delivered his ruling;

If what happened in the eight years of Amin’s terror rule was to be written down, there would be no space in the library of Uganda to house the literature – Justice Kakaru

Extension of term of by parliament breaks the sovereignty of the people and supremacy of the constitution. The abolishment means Parliament can even abolish the judiciary and invest its powers in itself based on a legal misconception – Justice Kakuru

I find that there was no public participation because the bill was presented, debated and passed on the same day – Justice Kakuru

The argument by the Attorney General that parliament can amend any part of the constitution provided there is a majority is fiction and is based on misconception of the law-Justice Kakuru

MPs don’t have power to legislate, power belongs to people who delegate it to MPs every 5 years, anything otherwise is unconstitutional-Justice Kakuru

I declare that the entire constitutional amendment Act 1 of 2018 is unconstitutional and therefore null and void. All its provisions ought to be expunged from the Constitution of Uganda – Justice Kakuru
